A Dimensão Econômica da Efetividade dos Direitos Fundamentais

A teoria econômica, em que se fundamenta a política econômica, sofreu mudanças importantes desde a ascensão da macroeconomia no período entre as duas guerras mundiais do século XX. Contudo, mesmo após o subsequente surgimento de novas ideias jurídicas sobre a economia, juristas se defrontam com limitações à sua capacidade de formação de juízos normativos sobre violações a direitos fundamentais que sofrem impactos de políticas macroeconômicas. O presente trabalho discute conceitos das perspectivas jurídicas surgidas nas últimas décadas, que focalizam temas econômicos, e propõe ideias preliminares para que juristas passem a abordar analiticamente o papel da política macroeconômica na obliteração da efetividade de direitos fundamentais. Além disso, o trabalho descreve tarefas analíticas e construtivas úteis no tratamento de questões jurídicas relacionadas a impactos de políticas macroeconômicas.
